Underage DUI in New Jersey

According to the division of highway safety traffic in New Jersey, drunk driving is a zero-tolerance law applied to those who are 21 years of age and under. This is commonly referred to as a baby DUI. Zero-tolerance laws make it illegal for young drivers with even a small amount of alcohol in their system to operate a vehicle.

The state of New Jersey has thoroughly tried to reduce DUI’s by enforcing strict consequences to those who risk the many harms of driving while under the influence. For many underage drivers, operating a motor vehicle while under the influence can have serious effects that are not worth the risk.

If you are under 21, driving with any detectable amount of alcohol in your system (.01 BAC or above) and are convicted for violating New Jersey’s zero tolerance law, the penalties are:

  •  Loss or suspension of driving privileges for 30 to 90 days
  •  15 to 30 days of community service
  • Referral to an IDRC (intoxicated driving program) or participation in an alcohol and traffic safety education program

A person operating a vehicle in New Jersey and has a BAC (blood alcohol concentration) of 0.08 percent or higher can receive a DUI.

First Offense:

If your BAC is 0.08 percent or higher, but less than 0.10 percent here are the possible penalties;

  • A fine of $250-$400
  • Imprisonment for up to 30 days
  • Driver’s license forfeiture until ignition interlock installed. Interlock required for 3 months.
  • A minimum of six hours a day for two consecutive days in an Intoxicated Driver Resource Center
  • An automobile insurance surcharge of $1,000 a year for 3 years.

If your BAC is 0.10 percent or higher, but less than 0.15 percent here are the possible penalties;

  • A fine of $300-$500
  • Imprisonment for up to 30 days
  • Driver’s license forfeiture until ignition interlock (IID) installed. Interlock required for 7 months-1 year.
  • A minimum of six hours a day for two consecutive days in an Intoxicated Driver Resource Center
  • Insurance surcharge of $1,000 a year for 3 years.

Second Offense:

  • Fine of $500-$1000
  • 48 hour-90-day imprisonment
  • Participation of IDRC
  • Insurance surcharge of $1,000 a year for 3 years.
  • IID installed for 2-4 years.

Third Offense:

  • Fine of $1,000
  • Imprisonment for 180 days
  • 8 year license suspension
  • 30 days community service
  • Participation of IDRC
  • Insurance surcharge of $1500 a year for 3 years
  • IID installed for 2-4 years
